These Terms and Conditions (“Terms”) regulates the acquisition, purchase and use of gift cards (GIFT CARD) and are therefore applicable to users (client interested in the photo shoot and / or buyer), beneficiaries (persons who exchange the gift card for a photo session) from the GIFT CARD and photographers.
Your access and use of the web platform and the GIFT CARD constitutes your agreement to be subject to these Terms, which establish a contractual relationship between you and Caro Navarro Photography. If you do not agree to these Terms, you cannot access or use the Platform and GIFT CARD.
Caro Navarro Photography gift cards (“Maria Carolina Navarro”) can be purchased and redeemed through the www.caronavarro.com website. The purchase or exchange of gift cards constitutes acceptance of the terms and conditions of Caro Navarro Photography. Caro Navarro Photography will provide gift cards electronically by email with an order number that the beneficiary will be required to make the exchange of the GIFT CARD.
GIFT CARDs are non-refundable, are valid for one year from the date of purchase and can only be redeemed through future Caro Navarro Photography services, and cannot be applied to previous purchases. When a GIFT CARD is redeemed, the value of the Gift Card is converted into a credit in the redeemer’s account. The balances and / or credit contained in your GIFT CARD will be applied against the total value of the purchased photo package and not on specific items in said package. If any purchase of photography services or packages exceeds the credit that the GIFT CARD has available, the balance must be paid with a credit card or any other payment method accepted by Caro Navarro Photography. Each type of GIFT CARD contains the description of products and services that are purchased, therefore, the user or beneficiary may not exchange products and services other than those described in each package. If the user wishes to purchase additional products and services, they must make their respective purchase and pay through the accepted payment methods. The services and products that are not described in the characteristics of each GIFT CARD cannot be exchanged using the GIFT CARD.
The balance of one GIFT CARD cannot be combined with the balance of another GIFT CARD. GIFT CARDS cannot be paid with more credit, each GIFT CARD will only have the value (price paid) of each package available, nor can it be exchanged together with a coupon or other promotions for the same order. Except as expressly permitted by Caro Navarro Photography, GIFT CARDs may not be transferred for value, resold, or used to purchase prints or other GIFT CARDs. Except to the extent required by applicable law, GIFT CARDs cannot be exchanged for cash or checks and GIFT CARD balances cannot be transferred to credit card accounts or accounts of other means of payment.
Caro Navarro Photography reserves the right to cancel the GIFT CARD or any part of the balance thereof, and request alternative forms of payment, cancel the respective Account and take legal action, if Caro Navarro Photography suspects that a GIFT CARD is abused, used or obtained fraudulently, illegally or otherwise, in violation of these terms and conditions.
The purchased package and the risk of loss of the GIFT CARD are transferred after the electronic issuance of Caro Navarro Photography by the GIFT CARD to the buyer, user or recipient / beneficiary of the GIFT CARD. Caro Navarro Photography has no obligation to replace lost, destroyed or stolen GIFT CARDs, in the event that this occurs, users or beneficiaries must report the lost, destroyed or stolen GIFT CARDs by contacting the administration team ( info @caronavarro.com ). Caro Navarro Photography is not responsible if your GIFT CARD is used without your permission.
CANCELLATION POLICY
In case the user or beneficiary cannot attend the photo session, please contact us as soon as possible and we will do everything possible to reorganize the date of the photo session; however, we cannot guarantee that the selected photographer will be available at another date / time. If the user or beneficiary loses the scheduled date for the session, it will not be reimbursed, but their GIFT CARD will remain in force for 1 (one) year from the date of purchase. You can also transfer the GIFT CARD to another beneficiary for its exchange as long as it is exchanged within its validity.
If the photo session is canceled due to photographer reasons, the GIFT CARD will be reimbursed in full. Please note that we will always try our best to reschedule your photo shoot so there are no cancellation fees.
Notification of cancellation by the User:
Caro Navarro Photography is not responsible for and will not refund any additional fees charged to the customer by the provider of their bank / card for receiving the refund specified above.
PAYMENT POLICY
Caro Navarro Photography shows prices in US dollars. We have no control over the exchange rates set by banks and we are not responsible for the exchange rates used by the payment method.
DELIVERY OF PHOTOGRAPHS
We will send a link by email where you can access your gallery and download your photos, the link will be sent to the email you assigned in the reservation form. The photographer makes the final selection of the photographs (number of photographs specified in the selected package). After your photo shoot, we will send your photos to you within 48 hours. RAW files are never delivered to the client. If there are more photos that the photographer considers not to be missed and that are not within those specified in the package that he purchased, we will send the user a gallery with a watermark preview of the best photos. The user will be able to make his selection of photos specified in the package. The user can select more photos than specified in the package. Each additional photo has a cost of $ 10.00 USD. The user will pay for the additional photos once the selection is completed through the payment methods allowed on our site. The complete selection of photos is delivered to the customer within 48 hours of purchase.
COPYRIGHT
You have the right to use all photos submitted for personal, non-commercial use only. The user could, for example, print the photos, share them with friends, publish them on their social networks, etc., if the user or beneficiary markets the photographs and receives payment for them, they must pay royalties to the photographer Caro Navarro Photography, which will be determined in function of the Federal Copyright Law. The photographer and Caro Navarro Photography perpetually retain the copyright of the photographs exclusively. We will never sublicense your photos. We reserve the right to use the photographs for promotional and curriculum purposes at Caro Navarro Photography as well as Caro Navarro Photography’s social media profiles, printed materials, etc. The photographer may use the photographs in the same terms that Caro Navarro Photography does. The user or beneficiary can inform us at any time that they do not agree to be used and the photographs will only be used for curriculum purposes on the Caro Navarro Photography website.
RISK POLICY
By booking the service, you agree that you are familiar with the chosen photographer’s style, package features, and agree to receive the photographs in such style, features, and quality. We have no control over circumstances of force majeure, fortuitous cases, extraordinary circumstances, health contingencies and weather conditions. However, we will try to reorganize (without guarantee) the day and time of the photo shoot. The payment is not refundable if it is impossible to carry out the photographic session, however the GIFT CARD will continue in force for the period of 1 (one) year under the terms of these conditions, as well as may transfer it to another beneficiary for its exchange according to the terms described here.
PRIVACY POLICY
It is our highest priority to protect all the data provided by Users. At Caro Navarro Photography we would not license or sub-license the data collected from customers, users or beneficiaries. By submitting the reservation form, you agree that we will collect your personal data, such as name, email, phone number and other information you send us. These data will be used only in relation to the management of your reservation, the acquired photo session and the delivery of the same. The personal data collected about you is stored for an indefinite period of time. You have the right to revoke your consent with the use and collection of your data at any time. In such case, we will delete your data from the database immediately.
These Terms and conditions and the provision of the services of Caro Navarro Photography will be governed by the applicable laws in Mexico. Any dispute arising from these Terms and Conditions and our services will be submitted exclusively to the courts of Playa del Carmen, Mexico. These terms apply to all reservations and packages of products and services purchased either by the user or exchanged by the beneficiaries. CONDITIONS OF SESSION OF PHOTOGRAPHS
Photographers: Caro Navarro will be the base photographer to carry out the photography sessions acquired in the GIFT CARD, but if when making your reservation and selecting the date Caro Navarro is not available, another photographer from the Caro Navarro team will be assigned with the same quality and style. In order to choose Caro Navarro, you must schedule your photography session 30 days before the session is due to take place.
Place: The photography session contained in the GIFT CARD can only be held within Quintana Roo, Mexico. If the user or beneficiary chooses a destination beyond 60km within Quintana Roo, they will pay the necessary travel expenses. Likewise, if the session is held in a park, cenote, hotel or any private destination, the user or beneficiary will pay the entry costs and other costs that are required by the destination. Caro Navarro will not be responsible for processing the accesses or permissions to carry out the Session. Caro Navarro will be able to suggest destinations.
Users or beneficiaries will be responsible for their own safety and medical expenses in the event of an accident. By acquiring and exchanging your GIFT CARD, you release Caro Navarro and the photographers who carry out the acquired session from all responsibility.
EXPRESS CONSENT: The users, beneficiaries or clients, when acquiring the GIFT CARD and / or the services and products offered by Caro Navarro Photography, accept all the Terms and Conditions described herein and are bound by them.
